Publicly Funded, Privately Locked: The Quiet Scandal Keeping American Scientists From Their Own Research

There is something structurally absurd about the way American research circulates — or, more precisely, fails to. A molecular biologist at a state university in Ohio spends three years conducting federally funded research on antibiotic resistance. Her findings are published in a prestigious journal. Six months later, a colleague at a smaller institution in the same state attempts to build upon that work and encounters a $45 paywall. Neither researcher finds this surprising. Both have accepted it as an unremarkable feature of academic life.

They probably should not.

The Architecture of the Problem

The United States federal government invested approximately $175 billion in research and development in fiscal year 2023, the vast majority of which flowed through agencies such as the National Institutes of Health, the National Science Foundation, and the Department of Energy. The implicit social contract underlying this investment is straightforward: public money generates public knowledge. What actually happens is considerably more complicated.

Researchers submit their findings to journals — often without compensation. Peer reviewers evaluate those submissions — also without compensation, and frequently employed at publicly funded universities themselves. The journals then package, brand, and sell access to this content back to the very institutions that produced it, sometimes at subscription costs exceeding hundreds of thousands of dollars annually for a single publisher's catalog. Individual article access for unaffiliated readers typically runs between $30 and $50 per paper.

The result is a system in which the American public funds discovery but does not own the product of that discovery. Academic libraries absorb subscription costs that have grown at rates far exceeding inflation for decades. And researchers at under-resourced institutions — community colleges, historically Black colleges and universities, regional state schools — frequently lack access to the literature their own field generates.

How Researchers Actually Get Around It

The scientific community has developed an elaborate informal economy to compensate for what the formal publishing system fails to provide. Email remains the most common tool: researchers routinely contact authors directly, invoking professional courtesy to request copies of papers. Most authors comply immediately. The practice is so normalized that some researchers embed contact information specifically for this purpose in their institutional profiles.

Social platforms designed for academic networking — ResearchGate being the most prominent — function partly as gray-market distribution systems, where authors upload their own work in apparent tension with the copyright agreements they signed upon publication. Publishers have issued takedown notices with varying degrees of consistency, producing a game of institutional whack-a-mole that neither side appears eager to resolve definitively.

Interlibrary loan services, a more formal mechanism, allow researchers to request materials through their home institution's library network. The process works but introduces delays that are poorly suited to the pace of contemporary research. A scientist tracking a fast-moving literature cannot always wait five to seven business days for a single citation.

Then there are the more legally ambiguous routes — repositories operating outside US jurisdiction that have indexed millions of paywalled papers. Usage of these platforms among American academics is widespread, rarely discussed openly, and a persistent source of discomfort for university administrators who understand the behavior without formally endorsing it.

The Institutional Politics Blocking Systemic Change

Why has the United States not resolved this more decisively? The answer involves a tangle of competing institutional interests that resists straightforward characterization.

Prestigious journals retain enormous influence over academic hiring and promotion. A paper published in Nature or Cell carries career-defining weight in ways that an equivalent paper deposited in an open repository does not — at least not yet. Researchers who might philosophically support open access often make pragmatic decisions to publish in high-impact paywalled venues because their tenure cases depend on it. Department chairs and promotion committees, operating under familiar evaluation frameworks, perpetuate the same incentive structures they themselves were shaped by.

Publishers, meanwhile, are not passive actors. Major commercial houses have lobbied actively against mandatory open-access policies and have simultaneously developed "open access" business models that shift costs from readers to authors, charging article processing fees that can exceed $10,000 per paper. Critics argue this approach democratizes reading while restricting who can afford to publish — a different inequity, not an elimination of inequity.

Federal policy has moved, but incrementally. A 2022 memorandum from the White House Office of Science and Technology Policy directed federal agencies to eliminate the existing twelve-month embargo period on publicly funded research, requiring immediate open access for papers resulting from federal grants by 2026. The policy represents genuine progress. It also took decades of advocacy to achieve and still contains implementation variables that will shape its practical impact.

Institutions Leading From Within

Against this backdrop, a number of American universities have developed institutional open-access repositories that deserve attention as models for systemic change.

MIT's open-access policy, adopted in 2009, requires faculty to grant the university a license to distribute their scholarly work through an institutional repository. The framework has since been adopted or adapted by dozens of other institutions. Harvard's Office for Scholarly Communication operates a similar infrastructure and has produced extensive documentation to assist other universities in replicating the model.

The University of California system made international news when it allowed its subscription contract with Elsevier — one of the largest commercial academic publishers — to lapse in 2019, citing unsustainable costs and misaligned values. After a multi-year negotiation, the system reached a new agreement that included open-access provisions for UC-authored papers. The episode demonstrated that large research institutions possess genuine leverage when they choose to exercise it collectively.

Smaller institutions have pursued different strategies. Some have redirected funds previously allocated to journal subscriptions toward supporting article processing fees for faculty publishing in fully open-access venues, effectively subsidizing a transition rather than simply absorbing the existing system's costs.

What Needs to Happen Next

The conversation about research accessibility is no longer marginal. It has moved into federal policy, university governance, and the professional associations that set norms across disciplines. What remains is the harder work of aligning incentives — ensuring that researchers are not professionally penalized for choosing open venues, that under-resourced institutions have genuine support rather than theoretical access, and that the definition of "open" does not simply relocate the financial barrier from readers to authors.
